Privacy policy

Effective date: September 5, 2026. This version replaces our Privacy Policy dated September 14, 2025.

Embroidery Inc ("Embroidery Inc," "EmbroideryINC," "we," "us" or "our") runs embroideryinc.com and the store, tools and services connected to it, including our custom embroidery ordering system, logo uploader, proof approval tool, customer accounts, live chat, email and text message programs, rewards program and social media pages (together, the "Services"). We are a California business located at 526 Main Street, Woodland, CA 95695.

This Privacy Policy explains what personal information we collect, how we use and share it, how long we keep it, and the choices and rights you have. It applies to everyone who visits our website, places an order, uploads artwork, contacts us, signs up for emails or texts, or otherwise interacts with us. It also serves as our notice at collection for California residents.

Our store runs on Shopify. Shopify processes some information as our service provider and some for its own purposes (see "Our relationship with Shopify" below). If this Privacy Policy conflicts with our Terms of Service, this Privacy Policy controls for anything about personal information.

By using the Services you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Services.

The short version

  • We collect what we need to make and ship your order: contact and shipping details, payment (handled by our payment processors; we never see your full card number), and the artwork, logos and text you want embroidered.
  • We keep your logos and digitized embroidery files on file so reorders are quick. You can ask us to delete them at any time.
  • We send marketing emails and texts only to people who opt in. Texts are always optional. Reply STOP to any text to end them.
  • Our site uses cookies, pixels and analytics tools, including session replay and advertising pixels from Google, Meta, Microsoft, TikTok and others. Sharing browsing data with ad platforms can count as a "sale" or "share" under some U.S. state laws. You can opt out on our Your Privacy Choices page.
  • We do not sell your personal information for money, and we never share your text message opt-in data or consent with anyone other than the providers that deliver our texts.
  • Questions or requests: email support@embroideryinc.com or call (628) 333-3857.

1. Information we collect

"Personal information" means information that identifies you or can reasonably be linked to you. It does not include information that has been de-identified or aggregated so it can no longer be linked to you. What we collect depends on how you interact with us.

Information you give us

  • Contact and identity details: name, email address, phone number, billing and shipping addresses and, for business customers, your company name, job title and the names and sizes of team members you order for.
  • Account information: email, password (stored in hashed form by Shopify), order history, saved addresses and any extra fields you fill in when you register, such as company or business type.
  • Order and payment information: the products, sizes, colors and quantities you order, discount codes and payment details. Payments are processed by Shopify Payments, Shop Pay, PayPal, Apple Pay and Google Pay. We receive confirmation of payment and the card type and last four digits, not your full card number.
  • Artwork, logos and embroidery text: the files you upload (PNG, JPG, SVG, PDF and similar), any names, titles, phone numbers, slogans or other text you ask us to stitch, placement and thread color choices, and notes to our designers. Artwork can contain personal information (for example, a staff name on a uniform). See "Artwork, logos and embroidered text" below.
  • Proof approvals and comments: your approval, change requests and comments on the proofs we send you.
  • Communications: anything you send us by email, phone, contact form, quote request, live chat, text message or social media, including attachments.
  • Marketing preferences: your email and text message subscriptions, the phone number you provide for texts, and your consent records (date, time, source and the wording you agreed to).
  • Reviews and photos: reviews, ratings, photos and other content you submit about our products, and your responses to review invitations.
  • Rewards and referral program information: your rewards account, points, referral links, the people you refer, and social accounts you connect to earn rewards.
  • Customer-supplied garments: details about items you send us to embroider.
  • Business documents: purchase orders, resale or tax exemption certificates, W-9 requests and similar documents for business accounts.

Information we collect automatically

  • Device and connection information: IP address, approximate location derived from your IP address (city or region level, never precise GPS location), browser type and version, operating system, screen size, language and device identifiers.
  • Usage information: the pages and products you view, searches, items you add to your cart or start checking out with, the time and length of your visit, links you click, the site that referred you, and any ad click identifiers in the link you arrived on (for example Google gclid, Microsoft msclkid, Meta fbclid or TikTok ttclid).
  • Cart and checkout status: cookies and similar technologies let us tell when items were left in a cart or a checkout was started but not completed, so we can send reminders to people who have opted in.
  • Session replay: we use analytics tools (currently PostHog and Microsoft Clarity) that record how visitors interact with our pages, including mouse movement, clicks, scrolling and the page content displayed. Text typed into form fields is masked by default in these recordings. We use them to find bugs and improve the site.
  • Email and text engagement: whether our messages were delivered, opened or clicked, and replies you send.

We collect this information using cookies, pixels, tags, software development kits and similar technologies. See "Cookies and tracking technologies" below.

Information we receive from others

  • Shopify: including Shop Pay and the Shop app, when you use them to check out or track orders.
  • Payment processors and fraud prevention services: payment confirmations, chargeback notices and risk signals.
  • Shipping carriers: tracking and delivery information.
  • Advertising and social media platforms: when you interact with our ads or pages, or submit a lead form on a platform such as LinkedIn, Meta or TikTok, the platform sends us the information you entered (for example name, email, phone, company and job title) along with campaign data.
  • Review platforms: reviews and ratings you post about us on Reviews.io, Trustpilot, Google and similar services.
  • People who refer you: if a customer refers you through our rewards program, we receive your name or email from them.
  • Organizations you belong to: if your employer, team or group orders for you, they may give us your name, size and role.
  • Service providers that help us verify addresses, prevent fraud or keep business contact records accurate.

2. How we use personal information

  • Making and delivering your order. Processing payments, digitizing your artwork, producing proofs, embroidering your items, arranging shipping, sending order, proof and shipping updates, and handling remakes, claims and cancellations.
  • Keeping your logo on file. Storing your artwork, digitized embroidery files and approved proofs so you can reorder without starting over and so we can match past work.
  • Customer service. Answering questions and quote requests, live chat, phone and email support, and resolving disputes.
  • Accounts. Creating and managing your account, rewards points and referral credits.
  • Marketing. Sending promotional emails, texts and postal mail you have agreed to receive, including new products, sales, reorder reminders, cart and checkout reminders and requests for reviews. Showing you ads for our products on other websites and apps, including based on products you viewed or bought. Measuring how well our marketing works.
  • Personalization. Remembering your preferences and cart, recommending products, and tailoring content and offers.
  • Analytics and improvement. Understanding how the Services are used, testing changes, fixing errors, and developing new products and features.
  • Security and fraud prevention. Verifying identity, protecting accounts, detecting and preventing fraud, abuse and chargebacks, and securing our systems.
  • Legal and compliance. Keeping tax and accounting records, responding to lawful requests, enforcing our Terms, protecting our rights and the rights of others, and meeting messaging, consumer protection and privacy law obligations, including keeping records of your marketing consent and opt-outs.
  • Business operations. Accounting, invoicing, audits, insurance, planning, and evaluating or completing a financing, merger, sale or other business transaction.
  • Showcasing our work. Photographing finished products for our website, social media and marketing, as described in our Terms of Service. We blur or mask personal information such as individual names or phone numbers that appear on items, and you can ask us not to feature your order.

We may also use de-identified or aggregated information (for example, order volume by product category) for any purpose. We do not use personal information to make automated decisions that have legal or similarly significant effects on you. Payment and fraud screening by Shopify and our payment processors may involve automated risk analysis that flags orders for our review.

3. Text message (SMS/MMS) program

This section describes our text message program and applies in addition to the rest of this Privacy Policy. It covers marketing texts as well as the transactional texts described below.

How you opt in

We send marketing text messages only to people who give us express consent. You can opt in by:

  • checking the text message marketing box at checkout and entering your mobile number;
  • entering your mobile number in a sign-up form or pop-up on our website and agreeing to receive texts;
  • texting a keyword we advertise to our number; or
  • giving us your mobile number and asking for texts in another way, such as in a conversation with our team.

When you opt in through our website, we may send you a confirmation text asking you to reply to complete your subscription (double opt-in). We record the date, time, method and wording of your consent and your IP address, and keep those records as described in "How long we keep personal information."

What you agree to

By opting in, you agree to receive recurring automated marketing text messages from Embroidery Inc at the mobile number you provided. Messages may be sent using an automatic telephone dialing system or other automated technology. Messages may include promotions, new product announcements, reorder reminders, cart and checkout reminders, proof and order-related reminders, sale and event notices, and requests for feedback. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies; you may receive a few messages a month, and more during sales or while you have an order in progress.

You confirm that you are at least 18 years old, that you are the account holder for the mobile number you provide or have the account holder's permission, and that you will let us know if you change or give up that number.

How to stop or get help

You can cancel at any time. Text STOP to any message we send you (STOP, END, CANCEL, UNSUBSCRIBE and QUIT all work). You will get one final text confirming you have been unsubscribed, and we will not send further marketing texts unless you opt in again. You can also unsubscribe using the link in a message or by contacting us at support@embroideryinc.com or (628) 333-3857. For help, text HELP to any message or contact us the same way.

Our texts come from our toll-free number, (888) 708-7565, and any other number we announce. Save it as Embroidery Inc so you recognize us.

Transactional and service texts

If you choose text messages for order notifications at checkout, Shopify sends order, shipping and delivery updates to that number on our behalf. We may also text you about a proof waiting for approval, a question about your artwork, or a delivery issue. These are service messages about your order, not marketing, and opting out of marketing texts does not stop them. You can stop order notification texts using the instructions in those messages or by contacting us.

Cart and checkout reminder texts

Embroidery Inc's website uses cookies and similar technologies to keep track of the items you put into your shopping cart and any checkout you start, including when you have abandoned your cart. If you have opted in to text messages, we use this information to determine when to send you a cart reminder by text message. If you have not opted in, we do not send cart reminder texts.

Your text message data stays private

We treat your mobile number and your text message opt-in information as confidential. We use them only to run this program and to keep the records the law requires. We share them only with the service providers that deliver our texts (currently Klaviyo) and their mobile carriers, and only so the messages can be sent. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All sharing described elsewhere in this Privacy Policy excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties. Your opted-out number is kept on a suppression list so we do not text you again by mistake.

Other program terms

  • We send marketing texts only during permitted daytime hours in your local time zone.
  • Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and network and is not guaranteed.
  • The program is available to mobile numbers in the United States and Canada. Canadian subscribers give express consent under Canada's Anti-Spam Legislation when they opt in.
  • We may change or end the program at any time. If we change these terms in a way that matters, we will post the update here and, where required, notify you by text or email.

4. Email marketing

You can sign up for our emails through our website forms and pop-ups, at checkout, or by asking us. Our newsletter uses double opt-in, so you may need to confirm your address before you receive marketing. Every marketing email includes an unsubscribe link, or you can email support@embroideryinc.com. Unsubscribing stops marketing emails but not emails about your account or orders, such as order confirmations, proof approvals, shipping notices and replies to your questions. Our proof emails come from proofs@embroideryinc.com, and Shopify sends order updates on our behalf.

We also send email reminders when items are left in a cart or a checkout is not completed, using the cookies described in this policy and the email address you entered at checkout or in a form. You can stop these with the unsubscribe link in any reminder.

5. Artwork, logos and embroidered text

Artwork is at the heart of what we do, so here is exactly how we handle it.

  • Uploads. Files you upload in the cart or send us by email are stored with our file hosting provider (currently Cloudinary) and in our order records. The upload is attached to your order so our production team can find it.
  • Digitizing and production. Our team, and any digitizing service providers working under contract with us, convert your artwork into embroidery files. Files are shared with them for that purpose only.
  • Proofs. Proofs are shared with you by email and through our proof approval tool (currently Proofer), which stores the proof image, your approval or change requests, and your comments.
  • Personal information in artwork. If your artwork or embroidery text includes personal information about you or others (names, titles, phone numbers, addresses), you confirm you have the right to give it to us. We use it only to make your order and keep the records described here. Tell us in advance if items include information that should be masked in any photos we take.
  • Logo on file. We keep your artwork, digitized files and approved proofs so reorders are quick and consistent. You can ask us to delete them at any time by emailing support@embroideryinc.com. Once deleted, future orders will need new digitizing.
  • Your rights in your artwork. You keep ownership of your logos and artwork. We use them only as described in this policy and in our Terms of Service. We do not sell, license or give your artwork to anyone for their own use.

6. Cookies and tracking technologies

Cookies are small files placed on your device. Pixels, tags and SDKs are pieces of code that work in a similar way. We and our providers use them for the following purposes:

Category What it does Examples of providers
Strictly necessary Runs the store: cart, checkout, login, security, fraud prevention, remembering your privacy choices. Shopify, Shop Pay, hCaptcha, Google reCAPTCHA
Functional Remembers preferences, powers live chat, sign-up forms, rewards, order tracking, reviews and the logo uploader. Gorgias, Klaviyo, BON Loyalty, ParcelPanel, Reviews.io, Helium Customer Fields, Cloudinary
Analytics and performance Counts visits, measures how pages perform, records sessions to find bugs, tests improvements. Shopify Analytics, Google Analytics 4, PostHog, Microsoft Clarity
Advertising Measures ad results, builds audiences, shows you our ads on other sites and apps, limits repeat ads. Google Ads, Meta (Facebook and Instagram), Microsoft Advertising, TikTok, OpenAI (ChatGPT ads)

Session replay. The analytics tools listed above may record your interactions with our pages, including mouse movement, clicks, scrolling and the content displayed. Form fields are masked by default. Recordings are kept under each tool's retention settings and used only to improve the site.

Your choices.

  • Use our Your Privacy Choices page to opt out of the sharing of your data for targeted advertising on this device and browser, and optionally for your account.
  • If a cookie banner appears for your region, use it to accept or decline non-essential cookies.
  • Turn on the Global Privacy Control (GPC) signal in your browser. Where the law requires, we treat it as an opt-out of sale, sharing and targeted advertising for that browser, and for your account if we can link the two. Learn more at globalprivacycontrol.org.
  • Block or delete cookies in your browser settings. Blocking necessary cookies may stop the cart and checkout from working.
  • Opt out of interest-based ads through Google Ads Settings, Meta ad preferences, Microsoft ad settings, your TikTok app settings, and the industry tools at optout.aboutads.info and optout.networkadvertising.org. To opt out of Google Analytics, install the Google Analytics opt-out add-on.

Other than the Global Privacy Control, we do not respond to "Do Not Track" browser signals because there is no accepted standard for them.

7. How we share personal information

We share personal information in the following situations. We do not sell personal information for money.

Service providers who work for us

Companies that process information on our behalf and under contract, only as needed to provide their service to us. Current categories and examples:

  • E-commerce platform and hosting: Shopify (store, checkout, customer accounts, order management, analytics).
  • Payments and fraud prevention: Shopify Payments, Shop Pay, PayPal, Apple Pay, Google Pay and their fraud screening services.
  • Shipping and order tracking: postal and parcel carriers, shipping label software, and ParcelPanel for tracking pages and notifications.
  • Artwork, digitizing and proofs: Cloudinary (file hosting), Proofer (proof approval) and contracted digitizers.
  • Email and text messaging: Klaviyo (email and SMS marketing, cart reminders, sign-up forms), Shopify (order notifications) and mobile carriers.
  • Customer support: Gorgias (live chat, help desk and on-site messages) and our business email and phone providers.
  • Reviews, rewards and account forms: Reviews.io (review invitations and display; our older reviews were collected through Judge.me), BON Loyalty (rewards and referrals) and Helium Customer Fields (account registration forms).
  • Analytics and site improvement: Google Analytics 4, PostHog, Microsoft Clarity and Shopify Analytics.
  • Business tools: customer relationship management software for business accounts and quote requests (currently HubSpot), accounting and invoicing software (currently QuickBooks), e-signature, document storage and productivity tools, and AI-assisted software we use to draft replies, analyze sales and website data, prepare artwork and run our business. These tools act on our instructions and are not used to make automated decisions with legal or similarly significant effects on you.
  • Professional advisers: accountants, lawyers, insurers and consultants bound by confidentiality.

Advertising and analytics partners

We let advertising partners, including Google, Meta, Microsoft, TikTok, OpenAI and, when we run campaigns there, LinkedIn, collect information about your activity on our site through cookies and pixels, and we may upload hashed contact details or customer lists to them to measure our ads and reach people like our customers. They may combine this with information from other sites. This can be a "sale," "share" or "targeted advertising" under some U.S. state laws, and you can opt out on our Your Privacy Choices page. These partners use the information under their own privacy policies. Shopify may also use information about your interactions with our store and other Shopify stores to support personalized advertising; see "Our relationship with Shopify."

Other situations

  • At your direction. For example, when you ask us to ship to someone else, share a proof with a colleague, post a review or connect a social account.
  • Organizations you order through. If you are part of a team or company order, the person managing that order may see your name, size and item details.
  • Affiliates. Businesses under common ownership or control with us, which must follow this Privacy Policy.
  • Legal reasons. To comply with law, subpoenas, court orders or government requests; to enforce our Terms and policies; to investigate fraud, security or safety issues; and to protect the rights, property and safety of Embroidery Inc, our customers and others.
  • Business transfers. In connection with a financing, merger, acquisition, reorganization, sale of assets or bankruptcy, personal information may be transferred to the other party, which must honor this Privacy Policy or give you notice of changes.

Text message data exception. None of the sharing described in this section includes text messaging originator opt-in data or consent. That information is shared only with the providers that deliver our texts, as described in Section 3.

8. Our relationship with Shopify

Our store is hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit is transmitted to Shopify and to third parties that may be located in countries other than where you live.

To help protect, grow and improve our business, we also use certain Shopify enhanced features (such as Shop Pay, the Shop app and Shopify's advertising and fraud tools) that use information from your interactions with our store together with your interactions with other merchants and with Shopify. For those features Shopify is responsible for processing your personal information, including responding to requests to exercise your rights. You can learn more in the Shopify Consumer Privacy Policy and exercise rights over Shopify-processed data through the Shopify Privacy Portal.

9. Rewards, referral and sign-up offers (notice of financial incentive)

We offer rewards in exchange for information: a discount for joining our email or text list, and a rewards program (run through BON Loyalty) that gives points for purchases, referrals, reviews and following us on social media, plus rewards for referring friends. To provide these, we collect and use identifiers (name, email, phone), commercial information (orders, points, referrals) and, if you connect them, social media account names.

Joining is optional. You opt in by signing up, and you can withdraw at any time by unsubscribing, asking us to close your rewards account, or emailing support@embroideryinc.com. If you withdraw, you may lose unused points or discounts.

California law asks us to estimate the value of your information in these programs. Our good-faith estimate is that the value is roughly equal to the discount or rewards you receive. We arrive at this by comparing what these programs cost us (discounts, rewards and software) with the additional sales they bring in. We do not otherwise assign a monetary value to your personal information.

10. Business customers

Many of our customers order for a company, team, school, crew or event. If you order on behalf of an organization, we may keep your business contact information, quotes, invoices and order history in our customer relationship management and accounting systems so we can serve your account. If you give us names, sizes, roles or other details about your team members, you confirm you are allowed to share them with us for the order. We use them only to make and deliver the order and to help with reorders.

11. Security

We use administrative, technical and physical safeguards designed to protect personal information, including encrypted connections (TLS) across the site, access controls that limit staff and providers to the information they need, and payment processing through PCI DSS compliant processors. We never store full payment card numbers on our own systems.

No method of transmission or storage is completely secure, so we cannot promise perfect security. Please keep your account password private and let us know right away at support@embroideryinc.com if you think your account has been accessed without permission. Avoid sending sensitive information through unsecured channels such as plain email.

12. How long we keep personal information

We keep personal information for as long as we have a business reason to hold it, and in practice we do not delete most records on a fixed schedule. Our reasons include making reorders easy (your artwork and digitized files), proving that marketing consent was given, honoring opt-outs, meeting tax and accounting rules, resolving disputes and defending claims, and keeping an accurate history of the work we have done for you. We delete or de-identify information when you ask us to (see Section 14), when we close an account or program and no longer need the records, or when a legal requirement to keep them has passed and we have no further use for them. Where the law where you live requires us to delete information sooner, we follow that law.

How this applies to each kind of information:

Information How long we keep it
Orders, invoices, payments and tax records Indefinitely, as permanent business records. Tax and accounting law requires at least 7 years.
Account information For as long as your account exists. We do not delete inactive accounts on a schedule. You can ask us to delete your account at any time.
Artwork, digitized files and approved proofs Indefinitely, so you can reorder at any time and we can match earlier work, unless you ask us to delete them.
Marketing lists (email and text) Until you unsubscribe. Unsubscribe and opt-out records are kept permanently so we keep honoring your choice.
Text message consent records Permanently, so we can show that consent was given and keep honoring opt-outs.
Marketing leads from web forms and ad platforms Indefinitely, unless you unsubscribe or ask us to delete your information.
Support conversations Indefinitely, as part of your customer history.
Analytics and session recordings For as long as each analytics provider retains them under its own settings. We do not currently apply a shorter limit of our own.
Legal claims, disputes and fraud records Indefinitely.

Backup copies may persist for a period after deletion until they are overwritten in the normal course of business.

13. Children

The Services are for adults. We do not knowingly collect personal information from anyone under 16, and you must be at least 18 to join our text message program. If you believe a child has given us personal information, contact us and we will delete it. We do not have actual knowledge of selling or sharing the personal information of anyone under 16.

14. Your rights and choices

Depending on where you live, you may have some or all of the following rights. They are not absolute and may be limited by law, but we honor them for everyone where we reasonably can.

  • Know and access: learn what personal information we have about you and receive a copy.
  • Correct: fix inaccurate information. You can update most account details by logging in.
  • Delete: ask us to delete your personal information, including your artwork on file, subject to legal exceptions such as records we must keep.
  • Portability: receive your information in a portable format.
  • Opt out of sale, sharing and targeted advertising: use Your Privacy Choices or turn on the Global Privacy Control signal.
  • Limit use of sensitive personal information: we use sensitive information (such as your login credentials) only for purposes the law allows without a right to limit, but you can still contact us with concerns.
  • Opt out of marketing: unsubscribe from emails using the link in any email, text STOP to end texts, or email us to stop postal mail. We may still send you non-marketing messages about your orders and account.
  • Withdraw consent: where we rely on consent, you can withdraw it at any time without affecting earlier processing.
  • Object or restrict: where the law allows, object to or restrict certain processing, including profiling for marketing.
  • Appeal: if we decline a request, ask us to reconsider.
  • Non-discrimination: we will not deny you goods or services, charge different prices or provide a different level of service because you exercised your rights, except as permitted for the rewards programs described above.

How to make a request

Email support@embroideryinc.com with "Privacy request" in the subject line, call (628) 333-3857, or write to Embroidery Inc, 526 Main Street, Woodland, CA 95695. Tell us what you would like us to do and the email address or phone number you used with us. You can also manage your data from your customer account where Shopify offers those options, and use the Shopify Privacy Portal for data Shopify controls.

Verification. We need to make sure a request comes from you or someone you authorized. We will usually confirm by sending a message to the email or phone number on file and, for sensitive requests, ask you to confirm details about your recent orders. We never ask for your password.

Authorized agents. You can have an agent make a request for you. We will ask for written proof that you authorized them and may ask you to confirm your identity directly.

Timing. We respond within 45 days of receiving a verifiable request, or sooner where a shorter period applies. If we need more time, we will tell you why and may take up to 45 more days. We do not charge for requests unless they are repetitive or excessive, and we will tell you before charging anything.

Appeals. If we decline all or part of a request, we will explain why. You can appeal by replying to our decision or emailing support@embroideryinc.com with "Privacy appeal" in the subject line. We respond to appeals within 45 days (60 days where the law allows) and will tell you how to contact your state attorney general or data protection authority if you are not satisfied.

We are based in the United States and process personal information there and wherever our service providers operate. When we ship to you or serve you outside the United States, your information is transferred to the United States and other countries whose laws may differ from yours.

Legal bases (EEA and UK). We process personal information to perform our contract with you (making and shipping your order, running your account), for our legitimate interests (running and improving our business, security, fraud prevention, and marketing to existing customers where permitted), with your consent (marketing emails and texts, non-essential cookies), and to comply with legal obligations (tax, accounting, consumer law). Embroidery Inc is the controller of this information. You may withdraw consent at any time and may complain to the Office of the Privacy Commissioner of Canada.
